MiCA-Licensed Crypto Exchanges 2026: Who Holds an EU Licence

Checked 2026-10-23 on ESMA's register: OKX, Bybit, Coinbase, Kraken, Gate, KuCoin and BingX hold MiCA authorisation; Binance and Bitget don't.

According to the CASP file of ESMA's interim MiCA register (last updated 2026-10-22, checked 2026-10-23), the large exchanges holding a MiCA crypto-asset service provider (CASP) authorisation are OKX, Crypto.com, Gemini, Gate and Blockchain.com (Malta MFSA), Coinbase and Bitstamp (Luxembourg CSSF), Kraken (Central Bank of Ireland), Bybit, KuCoin, BingX and Bitpanda (Austria FMA), Bitvavo (Netherlands AFM), eToro and Revolut (Cyprus CySEC), Robinhood (Bank of Lithuania) and Bit2Me (Spain CNMV). Binance, Bitget, MEXC and HTX were not on the register that day. The MiCA transitional period ended on 1 July 2026 at the latest, so a firm without MiCA authorisation can no longer, as a rule, provide crypto-asset services to EU clients.

A name on the register says nothing about the exchange's global site. Each authorisation belongs to one EU legal entity and covers only the services and countries the register lists. When you check a MiCA licence, check three things: the entity, the services and the countries it is passported to. The results come first below, followed by passporting, the transitional period and how to search the register yourself.

Quick answer

  • MiCA CASP authorisation: OKX, Bybit, Gate, KuCoin, BingX, Coinbase, Kraken, Crypto.com, Bitstamp, Bitvavo, Bitpanda, Gemini, Blockchain.com, eToro, Revolut, Robinhood, Bit2Me and others, each granted by the regulator of its home member state.
  • Not on the register: Binance (withdrew its Greek application on 2026-06-24), Bitget (Bitget EU has applied to Austria's FMA, no decision yet), MEXC (on ESMA's non-compliant list), HTX, Pionex, WEEX, XT.COM, CoinW, Ourbit and Bitfinex.
  • Authorised but not yet allowed to operate: Austria's FMA said on 2026-05-18 that KuCoin EU Exchange GmbH may still not commence business operations.
  • Passport coverage differs: Bybit EU and KuCoin EU do not list Malta; BingX EU lists neither Spain nor Malta.
  • MiCA does not cover derivatives: crypto-assets that qualify as financial instruments are outside MiCA, and none of the register's service codes is a product like perpetual futures.

The table lists only records found on the ESMA register. The "Services" column uses the register's codes, explained in the next section. The "Passport" column is the list of countries in the register's ac_serviceCode_cou field, measured against the 30 countries of the European Economic Area (EEA).

Checked 2026-10-23 (UTC+8). Sources: ESMA MiCA page and its CASP register CSV (page marked last updated 2026-10-22). The authorisation date is the register's ac_authorisationNotificationDate field. Regulators differ on whether they write the home state into the passport field; "whole EEA" means the home state plus every other country is covered.

That day's CASP file held 387 records. Germany had the most with 117, followed by France with 36, the Netherlands 29, Cyprus 25 and Malta 23. Two records carried a withdrawal date, neither of them an exchange in the table.

What the register's service codes mean

Article 3(1)(16) of MiCA lists ten crypto-asset services, and the ESMA register labels them a to j:

CodeServiceWhat it looks like to a regular user
aCustody and administration of crypto-assets on behalf of clientsCoins held in your exchange account
bOperation of a trading platform for crypto-assetsAn order book where users' orders are matched with each other
cExchange of crypto-assets for fundsBuying or selling coins for euros
dExchange of crypto-assets for other crypto-assetsCoin-to-coin swaps
eExecution of orders for crypto-assets on behalf of clientsThe platform executes your order in the market
fPlacing of crypto-assetsNew token sales and placements
gReception and transmission of orders for crypto-assetsYour order is passed to another firm to execute
hProviding advice on crypto-assetsPersonal recommendations
iProviding portfolio management on crypto-assetsA managed portfolio
jProviding transfer services for crypto-assets on behalf of clientsDeposits, withdrawals and internal transfers

In the table above, only OKX, Gate, Bitstamp, Bitvavo, Revolut and Kraken's Payward Global Solutions hold code b, operation of a trading platform. The authorisations of Bybit EU, KuCoin EU and BingX EU are a, c, d and j (plus f for Bybit and KuCoin), with no b. The register lists authorised services only and does not describe how each EU site executes trades; for that, read the user agreement of the EU site.

MiCA does not cover crypto-assets that qualify as financial instruments. Article 2(4) of MiCA excludes them (ESMA interactive single rulebook, MiCA Article 2), and none of the ten services on the register is a derivative. A MiCA authorisation therefore says nothing about whether an exchange's perpetual futures are regulated under MiCA; derivatives fall under the EU's separate rules for financial instruments.

Binance's announcement does not say which products stop or which countries are affected, and we do not fill that gap with other sites' accounts. For each exchange's restrictions in European countries, see restricted countries of the big four exchanges.

Authorised but not yet operating: KuCoin EU

Austria's FMA authorised KuCoin EU Exchange GmbH under MiCA on 2025-11-27 for custody, crypto-for-funds and crypto-for-crypto exchange, placing and transfer services (FMA authorisation notice). On 2026-02-19 the FMA banned it from taking on new business because its anti-money-laundering and sanctions officer roles, and their deputies, were no longer properly staffed. Those roles were filled again and the ban was lifted on 2026-05-18, but under a separate decision of 2026-02-18, KuCoin EU may still not commence business operations because governance requirements and other key functions are not yet fully met (FMA notice of 2026-05-18). We found no later FMA notice lifting that restriction as of the check date.

An authorisation on the register and the ability to open an account and trade today are two separate things. KuCoin EU shows that you also need to check the home regulator for later decisions.

BingX EU: authorised on 2026-10-13

The FMA announced on 2026-10-14 that, by decision of 2026-10-13, it had authorised MEGE zweite GmbH under MiCA for custody, crypto-for-funds and crypto-for-crypto exchange, and transfer services (FMA authorisation notice). On the ESMA register the record's commercial name is BingX EU and the website bingx.eu; its passport list leaves out Spain and Malta. BingX's official update of 2026-06-16 said "no MiCAR authorisation has been granted at this stage" and gave no launch date (BingX update); on the check date we found no official BingX launch date for bingx.eu.

The authorisation belongs to the EU site. The global bingx.com site has its own user agreement, restricted regions and contracting entity; see which legal entity you sign with at each exchange.

What passporting means

A MiCA authorisation is granted by one member state's regulator, and the firm can then passport it to other EEA countries without applying again in each one. Under Article 65 of MiCA, the firm notifies its home regulator of the countries, services and start date it plans; within 10 working days the home regulator passes this on to each host country's single point of contact, ESMA and the European Banking Authority (EBA), and tells the firm. The firm may start once it receives that communication, or at the latest from the 15th calendar day after submitting the information (ESMA interactive single rulebook, MiCA Article 65).

The register's passport field is the result of that notification. Bybit EU and KuCoin EU, both authorised in Austria, list 29 countries (no Malta); BingX EU lists 28 (no Spain, no Malta). If your country is not on the list, the firm's MiCA authorisation does not extend to you there.

"Reverse solicitation" also comes up. Article 61 of MiCA says no MiCA authorisation is needed when an EU client, on their own exclusive initiative, asks a third-country firm for a service. Once a third-country firm solicits clients in the EU, the service no longer counts as the client's own initiative, whatever the contract or a disclaimer says, and the firm may not use the exemption to market new products or services to that client (ESMA interactive single rulebook, MiCA Article 61).

The transitional period ended by 1 July 2026

Article 143(3) of MiCA let firms already operating under national law before 2024-12-30 continue until 1 July 2026, or until they were granted or refused MiCA authorisation, whichever came first; member states could shorten or skip the period. ESMA's list of national periods (ESMA list of grandfathering periods, version of 2026-05-20):

PeriodCountriesEnded by
6 monthsLatvia, Hungary, the Netherlands, Poland, Slovenia, Finland2025-06-30
9 monthsSweden2025-09-30
12 monthsGermany, Ireland, Lithuania, Austria, Slovakia, Norway2025-12-30
18 monthsBelgium, Bulgaria, Czechia, Denmark, Estonia, Greece, Spain, France, Croatia, Italy, Cyprus, Luxembourg, Malta, Portugal, Romania, Iceland, Liechtenstein2026-07-01

We worked out the "ended by" dates by counting months from 2024-12-30, using the 1 July 2026 date in Article 143 for the 18-month group. ESMA's footnotes add that some periods reflect what national regulators told ESMA they expected and may not yet be in national law, and that Bulgaria, Czechia, Denmark and Italy set their own application deadlines. Every period had ended by 1 July 2026, so a national VASP registration from before MiCA no longer stands in for a MiCA authorisation.

How to check an exchange's MiCA authorisation yourself

  1. Download the register

on ESMA's MiCA page, find the CASPs file (CSV) under "Interim MiCA Register" and open it in a spreadsheet.
  2. Search the name

try the brand, the full company name and the domain. BingX, for example, sits under the legal name MEGE zweite GmbH, with BingX EU only in the commercial-name column.
  3. Read services and countries

ac_serviceCode holds the authorised services and ac_serviceCode_cou the passport countries; check that your country is listed.
  4. Check the withdrawal date

a date in ac_authorisationEndDate means the authorisation has been withdrawn.
  5. Check the home regulator

search the company on the issuing regulator's website for operating restrictions or fines, as with KuCoin EU, and look at ESMA's non-compliant list (the NCASP file).
  6. Match the website and the contracting entity

ae_website is the EU site; the site where you open your account and the entity named in its user agreement should match it.

One check worked through: someone living in Spain wants BingX's EU service. The passport field for MEGE zweite GmbH lists 28 countries, and ES (Spain) and MT (Malta) are not among them, so on the 2026-10-22 register this authorisation does not cover Spain. Bybit EU's field has ES but no MT, so it covers Spain but not Malta. The same search for Binance, using Binance, Bifinity and Nest, returns no record.

How a MiCA licence relates to fee rebates

A rebate uses only your exchange UID. It never touches your funds, password or API keys, and it does not change which legal entity you contract with (are crypto fee rebates safe). Fee Otter's referral codes apply to each exchange's global site. The EU sites of Bybit, KuCoin, BingX and Gate are separately authorised entities, and their official pages do not say whether the global referral programmes apply there, so we make no assumption.

Rates on the global sites, from the 2026-10-22 rebate table: OKX 20% automatic rebate + exclusive rewards; Bybit 40% (all paid by Fee Otter); KuCoin 60% (all automatic); BingX 45% (all paid automatically by BingX when you sign up with code FEEOTTER, with no UID binding needed); Gate 70% (20% automatic + 50% extra). On Bybit's global site, a perpetual taker trade of 10,000 USDT notional at the regular rate of 0.055% (Bybit trading fee structure, updated 2026-09-02) costs 5.5 USDT; a 40% rebate returns 2.2 USDT, for a net fee of 3.3 USDT.

Service regions

MiCA applies only in the European Economic Area. Each exchange's global site lists its restricted regions in its own user agreement, and these often differ from the EU site's passport list; HTX's user agreement, for example, excludes the whole EU. Before signing up, confirm which site and which entity apply where you live. For licences in other regions, see crypto exchange licences by country.

Risks

A MiCA authorisation requires a firm to meet rules on capital, safekeeping of client assets and complaint handling, and the regulator can inspect, fine or withdraw it. It does not guarantee that the platform won't fail, and it does not cover trading losses. Leverage and futures can wipe out your margin quickly, and crypto-assets are not covered by deposit insurance. For past exchange failures, see crypto collapse history. This is a summary of public information, not legal or investment advice.

FAQ

Which crypto exchanges have a MiCA licence?

On the 2026-10-22 ESMA register, the EU entities of OKX, Bybit, Gate, KuCoin, BingX, Coinbase, Kraken, Crypto.com, Bitstamp, Bitvavo, Bitpanda, Gemini, Blockchain.com, eToro, Revolut, Robinhood and Bit2Me are among the large exchanges with authorisation.

Does Binance have a MiCA licence?

No. Binance is not on the 2026-10-22 register. It announced on 2026-06-24 that it had withdrawn its Greek application and would apply in another member state.

Does Bitget have a MiCA licence?

Not yet. Bitget announced on 2026-07-02 that Bitget EU has applied to Austria's FMA, and the register had no record of it on the check date.

Can a MiCA licence be used across the whole EU?

It can be passported, but only to the countries listed on the register. Bybit EU and KuCoin EU leave out Malta; BingX EU leaves out Spain and Malta.

When did the MiCA transitional period end?

By 1 July 2026 at the latest. Six countries, including the Netherlands and Poland, gave only 6 months; six, including Germany and Austria, gave 12; Sweden gave 9; the rest gave 18.

Are futures on a MiCA-licensed exchange regulated under MiCA?

No. Article 2(4) of MiCA excludes crypto-assets that qualify as financial instruments, and none of the register's ten services is a derivative.

Getting started

First confirm which site and entity apply where you live, then sign up there with a referral code and bind your UID on the Fee Otter rebate platform (BingX needs no binding). The exchange's automatic rebate goes straight back into your exchange account. Fee Otter's extra rebate is settled daily after the 16:00 (UTC+8) update and paid on request as on-chain USDT over BEP20, with a minimum of 1 USDT per request and a 0.015 USDT network fee paid by the user.

15 exchanges — extra rebate the moment you bind

Rates come live from the rebate page.
